SB 326 (2019) BALCONY LAW

Senate Bill SB326

New CA Senate Balcony Laws SB 326 (2019) now require inspections of wood-framed Exterior Elevated Elements (EEE). The first inspection must be completed by January 1st, 2025.

  SB 326 (2019) applies to common interest developments such as condominiums/townhomes or multi-family housing with 3 or more units controlled by residential homeowners’ associations (HOAs). Significant sample, meaning a sufficient number of units to be inspected to provide 95% confidence, +/- 5% margin of error.

· Who can inspect? 

  • Licensed Structural Engineer, 
  • Licensed Civil Engineer (AB 2114),
  • or licensed Architect.

· When and How Often? 

  • The first inspection must take place by Jan 1st 2025, and subsequent inspections are required every nine years. 
  • Provide copy of the inspection report to Association immediately upon completion of the Report, and to the local code enforcement agency within 15 days of completion of the report, if the exterior elevated element poses an immediate threat to the safety of the occupants.
  • The inspection reports to be incorporated into the HOA’s Reserve Study. Two cycles of EEE reports to be kept in the association records.
