ATTENTION CONDO & APARTMENT COMPLEX OWNERS/MANAGERS:

New Mandatory CA Senate Balcony Laws SB 721 (2018) and SB 326 (2019) now require inspections of wood-framed Exterior Elevated Elements (EEE). The first inspection must be completed by January 1st, 2025.

Owners of multi-family buildings with three or more dwelling units that have exterior elevated elements (EEE) which are located more than 6 feet above adjacent grade, such as decks or stairways, will need to comply with these Laws and must hire a licensed professional to inspect the building’s exterior elevated elements to ensure they are in a general safe condition and free of deterioration that could pose a safety hazard.

SENATE BILL SB721 (2018)

SB 721 (2018) Law applies to multifamily apartment buildings with 3 or more units. A sample of at least 15 percent of each type of exterior elevated element shall be inspected.

Who can inspect? 

  • Licensed Architect; 
  • Licensed Civil or Structural engineer; 
  • Licensed Building Contractor (A, B, or C-5) with at least 5 years experience constructing multistory wood frame buildings
  • Certified Building Inspector or Building Official from a recognized state, national, or international association, as determined by the local jurisdiction.

SB326

SENATE BILL SB326 (2019)

SB 326 (2019) applies to common interest developments such as condominiums/townhomes or multi-family housing with 3 or more units controlled by residential homeowners’ associations (HOAs).Significant sample, meaning a sufficient number of units to be inspected to provide 95% confidence, +/- 5% margin of error.

  • Licensed Structural Engineer, 
  • or licensed Architect

WHAT BUILDINGS MUST BE INSPECTED?

 All Buildings with 3 or more units that have:

  • EEE: Elevated Balconies, decks, porches, stairways, walkways, landings, stairway systems, railings, handrails and guardrails and entry structures that extend beyond the exterior walls of the building and that rely in whole or in substantial part on wood or wood-based products for structural support or stability; and
  • A walking surface that is elevated more than 6 feet above the ground level; and
  • Balconies designed for human occupancy or use.

INSPECTION PROCESS
